FRENTING TERMS OF SERVICE

Welcome to Frenting.

These Terms of Service ("Terms") govern your access to and use of the Frenting platform, website, and services (collectively, the "Platform") operated by Frenting LLC ("Frenting," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms.

1. Overview of the Platform

Frenting is a private, peer-to-peer platform that enables individuals to rent, lend, or share spaces and items within trusted groups ("Circles").

Frenting:

  • Does not own, control, or manage any listings
  • Is not a party to agreements between users
  • Provides technology only to facilitate connections

All transactions occur directly between users.

2. Eligibility

You must:

  • Be at least 18 years old
  • Have the legal capacity to enter into agreements
  • Provide accurate and truthful information

You are responsible for maintaining the confidentiality of your account.

3. User Roles

Users may act as:

  • Owners (listing spaces or items)
  • Guests (booking or borrowing)

You may act as both.

4. Listings and Transactions

4.1 Listings

Owners are responsible for:

  • Accurate descriptions, pricing, and availability
  • Disclosing known hazards or limitations
  • Setting rules and expectations

4.2 Transactions

  • All bookings and agreements are between users only
  • Frenting does not guarantee performance, payment, or fulfillment by an owner or renter

5. Payments and Fees

Frenting may charge service fees (e.g., booking or transaction fees). Payments may be processed via third-party providers (e.g., Stripe, Venmo, PayPal).

You agree that:

  • Frenting is not responsible for payment disputes between users
  • Third-party payment processors have their own terms

5A. Security Deposits

5A.1 Eligibility and Limitations

Security deposits are only supported for bookings of 7 days or less, due to limitations of payment authorization holds.

For bookings longer than 7 days: Security deposits may not be available. Owners are responsible for managing risk through other means.

5A.2 Deposit Authorization

Owners may require a security deposit for certain listings.

By booking a listing with a security deposit, you authorize:

  • Frenting's third-party payment processor Stripe to place a temporary authorization hold on your payment method
  • The hold amount specified at the time of booking

You acknowledge that:

  • Authorization holds typically expire after 7 days
  • Frenting does not control hold duration beyond what Stripe allows

5A.3 Purpose of Security Deposit

Security deposits may be used to cover:

  • Severe damage to property or items
  • Missing or stolen items
  • Other losses caused during the booking period

5A.4 Claims Against Deposit

If an Owner believes they are entitled to all or part of the security deposit, they must:

  • Submit a claim within the active authorization window (generally within 7 days of the start of the hold)
  • Submit the claim no later than 48 hours after the booking ends
  • Provide a description and, where possible, supporting evidence including photos

By using the Platform, Guests agree that:

  • Frenting may charge the Guest's payment method for approved claims
  • Such charges may be processed without additional authorization

5A.5 Role of Frenting

Frenting may, at its sole discretion:

  • Facilitate communication between users
  • Review submitted claims and responses
  • Make a determination on deposit disbursement

However, Frenting:

  • Is not obligated to investigate disputes
  • Does not guarantee resolution outcomes
  • Is not liable for decisions regarding deposit claims

All decisions made by Frenting (if any) are final and binding to the extent permitted by law.

5A.6 Release of Deposit Hold

If no claim is made within the applicable time period, the hold will be released automatically.

You acknowledge that refund timing depends on your bank or card issuer. Frenting is not responsible for delays caused by financial institutions.

5A.7 Insufficient Funds / Failed Charges

If a charge related to a deposit claim fails:

  • You agree to promptly pay the outstanding amount upon request
  • Frenting may suspend or terminate your account until resolved

5A.8 No Guarantee of Coverage

Security deposits:

  • May not fully cover damages or losses
  • Do not replace insurance
  • Owners remain responsible for managing risk beyond the deposit amount

6. No Insurance

Frenting does not provide insurance coverage.

You acknowledge:

  • Listings are not insured by Frenting
  • Transactions are not protected by guarantees
  • You are solely responsible for obtaining any insurance you deem necessary

7. Assumption of Risk

Use of spaces and items involves inherent risks.

You voluntarily assume all risks, including:

  • Personal injury or death
  • Property damage or loss
  • Theft or misuse
  • Environmental or equipment hazards

8. Release of Liability

To the fullest extent permitted by law, you agree to release and hold harmless Frenting LLC and its affiliates, and other users (including Owners and Renters), from any claims, damages, or losses arising out of: use of the Platform; use of any listing; interactions between users.

This includes claims arising from negligence, except where prohibited by law.

9. User Responsibilities

Guests agree to:

  • Use listings safely and responsibly
  • Follow all rules set by Owners
  • Return items in original condition (normal wear excepted)

Owners agree to:

  • Provide accurate information
  • Disclose known risks
  • Maintain reasonably safe conditions

10. Prohibited Conduct

You agree not to:

  • Misrepresent listings or identity
  • Use the Platform for illegal purposes
  • Harass, discriminate, or harm others
  • Circumvent fees in bad faith
  • Damage property or misuse items

11. Disputes Between Users

Frenting is not responsible for disputes between users.

We may, but are not obligated to: facilitate communication; assist in resolving disputes.

All liability remains with the users involved.

12. Indemnification

You agree to indemnify and hold harmless Frenting LLC, its officers, employees, and affiliates, from any claims, damages, or expenses (including legal fees) arising from: your use of the Platform; your violation of these Terms; your negligence or misconduct.

13. Limitation of Liability

To the fullest extent permitted by law:

Frenting's total liability shall not exceed the total fees paid to Frenting in the past 12 months, or $500, whichever is greater.

Frenting is not liable for: indirect, incidental, or consequential damages; lost profits or opportunities.

14. Platform Availability

We strive to keep the Platform safe, secure, and available at all times. However, we do not guarantee that the Platform will be uninterrupted, error-free, or completely secure at all times.

We may modify or discontinue features at any time.

15. Termination

We may suspend or terminate your account if you violate these Terms or pose risk to other users or the platform.

You may stop using the Platform at any time.

16. Privacy

Your use of the Platform is also governed by our Privacy Policy.

17. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.

18. Dispute Resolution

Any disputes arising under these Terms shall be resolved by:

  • Binding arbitration in Wisconsin
  • On an individual basis (no class actions)

19. Changes to Terms

We may update these Terms at any time.

We will notify users of material changes by posting updated Terms and updating the "Last Updated" date.

Continued use of the Platform constitutes acceptance.
